Abstract

Perjanjian Penundaan Penuntutan atau Deferred Prosecution Agreement (DPA) telah memperoleh dasar hukum positif melalui Pasal 328 Undang-Undang Nomor 20 Tahun 2025 tentang Kitab Undang-Undang Hukum Acara Pidana. Legitimasi penggunaannya dalam perkara korupsi korporasi tidak cukup ditentukan oleh efisiensi penuntutan dan pemulihan kerugian negara. Penelitian ini menganalisis kecukupan desain normatif DPA dan merumuskan model berbasis keadilan distributif korporasi. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan, konseptual, dan perbandingan terhadap hukum Indonesia, Amerika Serikat, dan Inggris. Hasil penelitian menunjukkan bahwa Pasal 328 KUHAP 2025 telah menyediakan persetujuan dan pengawasan pengadilan serta syarat pemulihan dan pembenahan kepatuhan, tetapi belum menetapkan secara rinci kriteria kelayakan, batas waktu, transparansi, standar pemantau independen, prioritas pembayaran, perlakuan terhadap pelaku berulang, dan jaminan penuntutan individu. Model yang diusulkan mendistribusikan beban menurut kesalahan dan manfaat yang diperoleh, memprioritaskan pemulihan korban dan negara, mempertahankan pertanggungjawaban perseorangan, dan melindungi pemangku kepentingan yang tidak bersalah dari dampak pemidanaan yang tidak proporsional.

    Satria Abdi, S.H., M.H., is a doctoral candidate in law at the Faculty of Law, Universitas Sumatera Utara, and a career prosecutor at the Attorney General’s Office of the Republic of Indonesia. He currently serves as Assistant for Special Crimes at the Bali High Prosecutor’s Office in Denpasar. His academic and professional interests include anti-corruption law, corporate criminal liability, asset recovery, prosecutorial policy, and deferred prosecution agreements.
